Terms & Conditions

In the following Terms & Conditions term “the Photographer(s)" shall mean Grzegorz Gniady and Katarzyna Bielecka trading as K&G Photography. "The Client(s)" shall be those persons defined as Bride and Groom in the wedding booking. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective, unless agreed by both parties in writing.



A non-refundable booking fee of £100 as well as full acceptance of these Terms and Conditions secures the time and services of the Photographers for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the Photographers due to cancellation. The booking fee will be deducted from the cost of the Clients' chosen package when calculating the final balance due. Payment in full of the remaining balance will be due three weeks before the Wedding Day. Weddings that are postponed to a later date will retain the fee at no extra cost as long as the Photographers can re-schedule for the new date and time.



At the time of booking, the Clients will outline broadly what is required and the Photographers will advise on planning, logistics and timings needed. It will be beneficial for both parties if we could arrange for another chat with Bride and Groom, closer to the time of the wedding (3-6 weeks) to iron out the details. In any case we will contact you by phone a few days before the Wedding to ensure that there have been no last minute changes.



a) The Client may cancel this contract at any time by giving a written notice to The Photographers. Cancellation in 3 calendar months or more before the wedding will result in all the money paid towards this contract to be returned back to the Client, less the booking fee. Cancellation less than 3 calendar months before the wedding and no more than 1 calendar month will result in 50% of the total amount payable becoming due. Cancellation within 1 calendar month before the wedding will result in 100% of the total amount payable becoming due.
b) The Photographers reserve the right to cancel this contract up to 1 calendar month before the wedding by giving the written notice. All the monies, including the booking fee, paid towards the contract shall be returned to the Clients.
c) It is understood that by not making the full payment to the Photographers by the due date, this contract becomes cancelled due to the Clients' negligence. In such event, the Photographers reserve the right to withdraw from the assignment.
d) K&G Photography reserves the right to immediately withdraw from the assignment, should its photographer(s) become subject of gross misconduct, or any kind of verbal or physical abuse from the Clients and/or Their Guests during the Assignment, this being the reason for for non-completion of the job with no liability to the Photographers and loss of all the monies paid towards the Wedding Services by the Clients.



The Photographers reserve the right to review all the photographs taken on the Wedding Day prior to presenting it to the Clients. All adjustments (brightness, contrast, sharpness etc.) are applied to the photographs manually as part of the assignment. Due to the amount of post-processing involved and the number of photographs taken, the proof copies of the full set of photographs is usually presented within 14-28 days after the Wedding. The Photographers however reserve the right to delay the final product's delivery by up to two weeks for any reason and shall notify the Clients of any changes beforehand. The final set of photographs will be presented not later than two calendar months after the Wedding Day. Any extra digital manipulation and/or artistic finish is available to the Clients as at an extra cost and is subject to a separate agreement. The Photographers however reserve the right to retouch photos as necessary at no extra cost. The Clients shall be then provided with the minimum of the agreed number of photographs that are at least 3000px along their longest edge with the resolution of 300dpi and the colour gamut of the sRGB palette. The photographs' short-to-long edge ratio shall be 5:7, however the photographers reserve the right to change the aspect ratio of any photograph. The Photographers will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes not possible to record exact colour as seen by the human eye. There is no right to reject on the basis of style or composition.



The Photographers will honour requests for specific family/group portraits, subject to the weather, time permitting and the availability and the cooperation of the person(s) concerned. All such requested photographs must form part of the Client’s final wedding order.



Although care will be taken with the photographs taken of the Wedding Day, the Photographers shall not be held responsible for photographs not produced due to a technical failure. In the unlikely event of both Photographers being unable to attend your wedding due to unforeseen circumstances, the photographers reserve the right to appoint another photographer to attend client's wedding on our behalf to undertake the wedding photography to his/her best ability. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. For a booking involving a church ceremony or at certain venues, the photographer's movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the Photographer's choice and the Photographer cannot accept responsibility for any obstructed view should this be the case.



It is understood that no other photographer, amateur or professional, shall be appointed to photograph at the wedding whilst the Photographers are working, and any breach of this agreement will constitute a reason for non-completion of the job with no liability to the Photographers and loss of Booking Fee by the Client. This does not apply to the family and/or friends taking snapshots, however in the spirit of cheerful cooperation the bride and groom agree to give the Photographers precedence over your guests in order to take the photographs required for the Wedding Services. We cannot be held liable for lack of wedding photos if guests taking their own photos of the Bride and Groom have continually interrupted the Photographers’ work.



All the photographs taken at the wedding are considered artistic works under the Copyright, Designs and Patents Act 1988 and therefore are copyrighted by the Photographers. The Photographers therefore grant the Clients the licence to copy, publish and/or print in full any and all photographs that are result of this assignment. It is understood that the Clients shall not use any of these photographs for personal profit. K&G Photography remains the sole author of the photographs taken on the Wedding Day and is hereby granted permission to use any of the photographs taken during the Wedding Day for public display, website and internet promotion, photographic contests, photography books and any other promotional purposes associated with promoting K&G Photography and/or its photographers.



Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.



This agreement shall be governed with accordance with the laws of England and Wales.
